Ho’Omau Privacy Policy

1. DATA COLLECTION TRANSPARENCY

California law requires us to disclose the categories of personal information we collect. Because Ho’Omau provides both social and physiological services, we collect the following:

2. SENSITIVE PERSONAL INFORMATION (SPI)

Under the CPRA, physiological data (blood markers) is classified as Sensitive Personal Information.

  • Collection: We only collect SPI with your explicit “Opt-In” consent via the BioEdge Direct portal.

  • Storage: This data is encrypted and stored separately from your public social profile.

  • No Sale of SPI: Ho’Omau never sells or shares your bloodmarker data with third-party advertisers or insurance providers.

3. THE SOCIAL NETWORK: WHAT IS PUBLIC?

By using RacePoint, you acknowledge that certain information is public by default to foster community engagement among athletes.

  • Public View: Your name, age group, race results, and “Pathfinder” status.

  • Private View: Your specific BioEdge bloodmarker values, billing history, and private messages remain hidden unless you explicitly choose to share them.

4. GEOGRAPHIC DATA TRANSFERS (Canary Islands & Beyond)

If you are an athlete attending our Canary Islands camp or are a citizen of the EU/UK:

  • GDPR Compliance: Your data is collected under the legal basis of “Contractual Necessity” (to provide the service).

  • Transfer: You consent to your data being transferred to and processed in the United States (California), where our primary servers are located.

5. YOUR CALIFORNIA PRIVACY RIGHTS

As a California-based user, you have the following rights:

  • Right to Know: You can request a report of exactly what data we have on you.

  • Right to Delete: You can request that we “forget” your profile (subject to legal record-keeping for e-commerce/taxes).

  • Right to Correct: You can update any computation errors in your profile data.

  • Do Not Sell or Share: While we do not sell data to brokers, you may opt-out of “Cross-Contextual Behavioral Advertising” via your account settings.

6. COOKIES & TRACKING

We use “Performance Cookies” to ensure the ComputePoint calculators function correctly and “Functionality Cookies” to remember your login across the Rider Portal and HQ establishments.

7. DATA RETENTION

We keep your bloodmarker data for the duration of your active membership to provide historical performance trends. Financial records are kept for 7 years to satisfy US tax requirements for our e-commerce operations.
