Ho’Omau Terms and Conditions of Service

1. ACCEPTANCE OF TERMS
By accessing RacePoint, using ComputePoint calculators, or participating in the Vegas in 24 support programs, you agree to be bound by these Terms and Conditions. If you are acting as a “Pathfinder” (early participant), additional loyalty terms may apply, but these Master Terms remain primary.

2. THE “ATHLETE’S DUTY” & INFORMATION DISCLAIMER
Ho’Omau provides advanced pre-event intel, including route data, rest stop locations, and course mapping (e.g., Phoenix to Vegas).

Verification Requirement: You acknowledge that course conditions, business operations (rest stops), and road access are subject to change without notice.

Assumption of Risk: Ho’Omau does not guarantee the accuracy of third-party data. If a rest stop identified in the Rider Portal is closed or inaccessible, Ho’Omau is not liable for any resulting injury, exhaustion, or failure to complete the event. The rider maintains the ultimate responsibility for their own due diligence and safety.

3. COMPUTEPOINT & ORACLE ACCURACY (Mathematical Disclaimer)
Our proprietary calculators, including the Age-Group Oracle, are performance estimation tools.

Calculation Errors: While we strive for perfection, you acknowledge that software “bugs” or computation errors can occur.

Non-Reliance: Decisions regarding race strategy, pacing, or qualification should not be based solely on ComputePoint data. Ho’Omau is not responsible for any “Massive Data Headaches” or negative athletic outcomes resulting from technical inaccuracies.

4. THE SUB-10 CHALLENGE & PRIZE PURSES
Participation in the Sub-10 Challenge is a “Contract of Skill.”

Verification: Ho’Omau reserves the absolute right to verify race results via official timing chips and secondary verification.

Disqualification: Any evidence of course-cutting, drafting (where prohibited), or data manipulation will result in immediate disqualification without recourse.

Taxes: Prize winners are solely responsible for all applicable local, state, and federal taxes.

5. BIOEDGE DIRECT & TESTING SERVICES
Ho’Omau provides bloodmarker panels and testing via standard mail.

Not Medical Advice: BioEdge results are for informational and athletic optimization purposes only. They do not constitute medical advice, diagnosis, or treatment.

Postal Delays: Ho’Omau is not liable for the degradation of samples due to shipping delays or “standard mail” errors beyond our control.

6. SOCIAL NETWORK & PUBLIC PROFILES
Athlete user pages are, by default, public-facing.

User Content: You grant Ho’Omau a non-exclusive license to display the data you upload.

Public Exposure: You acknowledge that your performance data and profile information are visible to the community. You are responsible for the content you post.

7. IN-PERSON SERVICES & CODE OF CONDUCT
This section applies to the Canary Islands camp, RacePoint HQ, and any Ho’Omau-hosted establishment.

Code of Conduct: All participants must adhere to our standards of sportsmanship. Ho’Omau reserves the right to remove any individual from a camp or physical location, without refund, for behavior that endangers others or violates our values.

Travel Liability: For international camps, athletes are responsible for their own travel insurance, visas, and health clearances.

8. E-COMMERCE & MERCHANT TERMS (Ho’Omau Store)
Merchant Status: Ho’Omau acts as the merchant of record for all products sold on the site.

Shipping & Title: Risk of loss and title for items pass to you upon our delivery to the carrier.

Returns: Returns are governed by our specific Refund Policy, integrated here by reference.

9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, HO’OMAU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING ATHLETIC DISQUALIFICATION OR PHYSICAL INJURY) ARISING OUT OF YOUR USE OF THE SITE OR RELIANCE ON OUR DATA.

10. GOVERNING LAW
These terms are governed by the laws of the State of California. Any legal action must be brought in the courts located within the jurisdiction of our California headquarters.
